In efforts to defend SCOTUS attack, Obama steps deeper in his own mess « The Greenroom: "This explanation doesn’t wash in light of his charges on Monday that the court was guilty of “judicial activism,” but let’s explore the notion of showing “deference to our duly elected legislature, our Congress.” Is that the same kind of deference that the “duly elected legislature, our Congress” showed the voters who sent them there when they ignored public sentiment and crammed through Obama’s signature health care legislation by means of false promises and parliamentary tricks such as the use of the nuclear option by the Senate?

In his explanatory remarks yesterday, the president also observed that “the burden is on those who would overturn a law like this.” But that’s precisely the opposite of what Justice Anthony Kennedy said during the oral hearings last week when he spoke of a “heavy burden of justification” on the part of those arguing on behalf of the individual mandate."
