John Yoo: Chief Justice Roberts and His Apologists - WSJ.com

John Yoo: Chief Justice Roberts and His Apologists - WSJ.com: "Given the advancing age of several of the justices, an Obama second term may see the appointment of up to three new Supreme Court members. A new, solidified liberal majority will easily discard Sebelius's limits on the Commerce Clause and expand the taxing power even further. After the Hughes court switch, FDR replaced retiring Justices with a pro-New Deal majority, and the court upheld any and all expansions of federal power over the economy and society. The court did not overturn a piece of legislation under the Commerce Clause for 60 years."

Can ObamaCare survive success? « Hot Air

Can ObamaCare survive success? « Hot Air: "ObamaCare backers could only claim cost control by shifting the costs for the Medicaid expansion to the states, while taking credit for more-or-less universal coverage.  That would mean either higher state taxes, reductions of other state services, or both.  By freeing the states from having to bear those costs, the bill will come due at the federal level instead, and Blahous thinks that will start sinking into the national consciousness soon:

The Supreme Court may have just set in motion of chain of events that could lead to the law’s being found as busting the budget, even under the highly favorable scoring methods used last time around.

I’m not sure that really does us any favors, but at least the reversal on the Medicaid expansion exposes the dishonesty of the “deficit-neutral” argument."

The Volokh Conspiracy: "President Jackson dealt the Bank a fatal blow by withdrawing federal deposits from the Bank, and moving them to state banks. President Romney can follow Jackson’s lead on his first day in office, instructing the Acting Secretary of Health and Human Services to use the waiver powers in the ACA statute to issue waivers to everyone for the individual mandate. Because the individual mandate is (supposedly) a tax, it can then be repealed through the budget reconciliation process, which cannot be filibustered."

GAO report: At least $1.4 billion of Obama’s stimulus went to tax cheats « Hot Air: "At the start of his term, one of President Obama’s ostensible goals for the $800 billion-strong Recovery Act was to strengthen the economic recovery by providing some cushion in the housing market. (Of course, he proclaimed, there would be mechanisms in place to prevent the possible abuse of his economic largesse.) Within the stimulus act’s provisions was a first-time homebuyer tax credit and mortgage assistance, which granted the Federal Housing Administration the authority to insure loans at a higher rate in high-cost housing markets. Applicants who were delinquent on their federal taxes weren’t supposed to be eligible to receive the FHA’s stimulus-assistance, but — gasp — the FHA didn’t really have a system in place to obtain that information.

The result? The federal government doled out almost $1.5 billion in tax credits and government-backed mortgage loans to tax cheats, according to a GAO audit released Wednesday."

Bernanke 'Twist' Strategy to Inflate Economy Prior to Election

Bernanke 'Twist' Strategy to Inflate Economy Prior to Election: "Various studies over the past two years estimate that private and public corporations are holding more than $2 trillion in cash on their balance sheets; with an additional $1 trillion in overseas profits (after paying taxes to the countries where those profits were made); another estimated $3 trillion in private equity capital; and more than $2 trillion in excess reserve lending power in our banking system.  Hence, if these studies are accurate, there is over an estimated $8 trillion of capital waiting to fund superior economic growth in our nation.  Even if the actual available capital is half that estimate or $4 trillion, that is still powerful and debt free economic stimulus waiting on the sidelines.  The only thing holding the private sector back is a failed ideology that government can control the private economy and that an extra-constitutional institution, the Federal Reserve (which was created by an act of Congress in 1913) could help the government in this miss-guided mission.  Now that is twisted!"

Future tense, X: The fourth revolution by James Piereson - The New Criterion

Future tense, X: The fourth revolution by James Piereson - The New Criterion: "The late economist Mancur Olson has argued that economies tend to grow more slowly as rent-seeking coalitions become pervasive and ubiquitous, since they divert resources from wealth-creating to wealth-consuming uses. This is one reason, he argues, why the United States grew so rapidly in the nineteenth century, and why West Germany and Japan grew so rapidly in the two or three decades after World War II. At such times, these economies were open to investment and entrepreneurship, and, as a consequence, they enjoyed historically high rates of growth. With the passage of time, all of these systems were gradually encumbered by coalitions seeking benefits through the state. Political paralysis and slow growth, Olson argues, are by-products of political systems captured by rent-seeking coalitions. These groups, operating collectively, can block any overall effort to cut spending or to address the problems of deficits and debt."

The reform and restriction of public-sector unionism (a key factor of demosclerosis) promotes economic growth. The exposure and elimination of crony capitalism promotes economic growth. Obama's Auto Bailout Was Really A $23 Billion Taxpayer Gift To The UAW - Investors.com: " In speech after speech, President Obama credits himself for saving the Detroit auto industry. Turns out that what Obama really did was spend $23 billion in taxpayer money to pay off his union friends.

Obama's big point of pride these days is that he didn't "let Detroit go bankrupt" and that due to his efforts, "not only did we save the auto industry, but we're actually seeing better cars made" and Detroit carmakers are "on top of the world once again."

On the surface, it seems to be true. Obama did up the bailout ante that President Bush started in 2008. And Detroit carmakers are doing better these days. In May, GM announced a $1 billion profit in Q1 2012, and Chrysler announced bigger-than-expected profit for the first three months of the year.

But the reality is even without the bailouts, GM and Chrysler likely would have survived. They just would have gone through normal bankruptcy proceedings — which many still-existing large firms have done before."

News from The Associated Press

News from The Associated Press: "The Obama administration will stop deporting and begin granting work permits to younger illegal immigrants who came to the U.S. as children and have since led law-abiding lives. The election-year initiative addresses a top priority of an influential Latino electorate that has been vocal in its opposition to administration deportation policies.

The policy change, described to The Associated Press by two senior administration officials, will affect as many as 800,000 immigrants who have lived in fear of deportation. It also bypasses Congress and partially achieves the goals of the so-called DREAM Act, a long-sought but never enacted plan to establish a path toward citizenship for young people who came to the United States illegally but who have attended college or served in the military."

James Sherk and Todd Zywicki: Obama's United Auto Workers Bailout - WSJ.com

James Sherk and Todd Zywicki: Obama's United Auto Workers Bailout - WSJ.com: "President Obama touts the bailout of General Motors and Chrysler as one of the signature successes of his administration. He argues that the estimated $23 billion the taxpayers lost was worth paying to avoid massive job losses. However, our research finds that the president could have both kept the auto makers running and avoided losing money.

The preferential treatment given to the United Auto Workers accounts for the American taxpayers' entire losses from the bailout. Had the UAW received normal treatment in standard bankruptcy proceedings, the Treasury would have recouped its entire investment. Three irregularities in the bankruptcy case resulted in a windfall to the UAW."

Obama Wants To Control The Economy While Making Sure Business Is Blamed For Any Failures - Investors.com

Obama Wants To Control The Economy While Making Sure Business Is Blamed For Any Failures - Investors.com: "The self-flattery of the vision of the left also gives its true believers a huge ego stake in that vision, which means that mere facts are unlikely to make them reconsider, regardless of what evidence piles up against the vision of the left, and regardless of its disastrous consequences.

Only our own awareness of the huge stakes involved can save us from the rampaging presumptions of our betters, whether they are called socialists or fascists. So long as we buy their heady rhetoric, we are selling our birthright of freedom."

"The President has said that the most important policy he could address in his second term is climate change," supposedly to "improve the world."

So forget about the abysmal jobless numbers above 8% for over three years, or the $15 trillion deficit that threatens to turn the U.S. into Greece. No, amid those very real calamities, climate change is more important.

If this isn't a sign of a president out of touch with reality, what is? If climate change is Obama's "most important" policy issue, then neither the Tea-Party-led victories around fiscal discipline — such as the Wisconsin vote, nor the West Virginia primary, here 40% of Democrats chose a jailbird to protest Obama's anti-coal agenda, made a dent on him."

Barack Obama calls Mitt Romney 'George' in latest election gaffe - Telegraph: "During a speech at the New Amsterdam Theater in Times Square, the president mixed up his Republican opponent with former Michigan Governor George Romney while contrasting their economic policies.
“We are not going back to a set of policies that say you’re on your own and that’s essentially the theory of the other side. You know, George Romney,” Mr Obama said."

HughHewitt.com Blog : Hugh Hewitt : Rumsfeld on Obama and Romney, Iran and Israel, Syra and Russia: " Well, I wasn’t there, but I listened to it several times, and I don’t see how it can be interpreted as anything other than telling a foreign leader, from a country that is notably unhelpful to us with respect to North Korea, unhelpful to us with respect to Iran and their nuclear program, unhelpful to us with respect to trying to get Syria to behave in a more responsible way and stop butchering people, it’s telling a leader of that country look, I’ve got an election, I can’t make concessions to you now. Think what the concessions on missile defense have done. It’s accomplished nothing. Think what the reset button has done. It’s accomplished nothing. There’s a word that describes people who keep trying to do the same thing and getting the same outcome, but keep hoping for a different outcome. And I think the last three and a half years, we’ve seen a president who has been constantly attempting to befriend people by diminishing us, and that he hasn’t quite figured out that it doesn’t work. Obamateurism of the Day « Hot Air

Obamateurism of the Day « Hot Air: "Obama could have cut a TV spot, a web ad, or even a voice-over for a last minute radio spot.  Instead, the deepest level of commitment Obama could muster for Barrett is a Twitter message.  And note that the tweet claims to have Obama doing something he refused to do literally — “standing by Tom Barrett.”  Not only did Obama do his best to avoid standing anywhere near Barrett in this election, Obama apparently couldn’t dare to be in the same state."

Articles: The Hillary Gambit: Will She Replace Biden?

Articles: The Hillary Gambit: Will She Replace Biden?: "But this would be the least of her troubles. Her high popularity is a measure of the American people's disappointment with Obama (they subconsciously transfer their yearning to respect their government to the least compromised member of the administration) and a tribute to their short memory.  Once she hits the campaign trail, Hillary's gaudy past will become fair game.  The Republicans are sure to dredge up her long rap sheet as the first lady of Arkansas and later of the United States.  The Whitewater Debacle (a fraudulent land deal gone sour); the Cattle Futures Caper (a $100,000 bribe handed to Governor Clinton via his spouse); the White House Travel Agency Affair (an attempt to grab a few measly positions for her own people by ruining seven innocent lives); the 900 raw files strong-armed from the FBI, obviously as a blackmail goldmine; the looting of White House furniture; the disastrous attempt to nationalize health care, which cost the Democrats control of both chambers of Congress in 1994; the endless string of lies ranging from silly little fibs to patently ludicrous (one is tempted to say, Hillary-ous) whoppers, exposing her as an inveterate liar...the list could go on and on. "

HughHewitt.com Blog : Hugh Hewitt : Rumsfeld on Obama: "The president's auto-filibuster function takes over whenever the president encounters a recorded question.  He really has lost his confidence when it comes to thinking-on-his-feet, and the "Polish Death Camps" face plant is only the most recent of a long line of increasingly embarrassing flubs. His engagements with the press now appear to be long exercises in eating up time without saying a thing so he can maintain the appearance of being in command of the situation even as the public increasingly tunes out his absurd claims and preposterous proposals."

Warren Accused of 'Repeated Instances of Scientific Misconduct' Before Harvard Hire

Warren Accused of 'Repeated Instances of Scientific Misconduct' Before Harvard Hire: "Harvard Law School hired Elizabeth Warren as a Visiting Professor in the fall of 1992, then offered her a full-time tenured faculty position in February 1993, despite a withering 1990 critique of the academic standards used in the 1989 book she co-authored. The critique was made by one of the nation’s leading legal scholars in personal bankruptcy at the time."

The Big-Spending Obamas - Jim Geraghty - National Review Online

The Big-Spending Obamas - Jim Geraghty - National Review Online: "Undoubtedly the 2012 election will focus more on the federal government’s spending under Obama than on the president’s personal spending. But the parallel between the two financial pictures is worth noting. Almost all spendaholics or those who are unable to control their spending engage in a certain amount of denial, an effort to fool themselves about the hard truths of their financial situation. They assure themselves that they must spend money now in order to save more money later, or they count on additional earnings that are unlikely to materialize (say, through rosy assumptions of future economic growth). When confronted with evidence of a serious problem, they assert that it doesn’t really matter (“No matter what some rating agency may say, we have always been, and we will always be, a AAA country”)."
